Terms of Service

These Terms govern your use of this website and any bookings between you ("Client") and KensiCam ("we", "us"). Browsing this site or booking a session means you accept these Terms.

1. Intellectual property & website content

All photographs, videos, posters, text, graphics, layout, branding, and logos shown on this website are the copyright of KensiCam, all rights reserved. Some images depict avatars or performances created by third parties — those underlying assets belong to their respective owners, and the photographic/cinematic rendering of them shown here remains our copyright.

You are welcome to view the content in your browser. You may not, without our prior written permission:

  • Copy, download, save, screen-capture, screen-record, or otherwise reproduce any photo, video, or other media displayed here
  • Republish, redistribute, or post any media on social platforms, websites, or other public channels
  • Use any media for commercial purposes, marketing, advertising, or AI/ML training datasets
  • Modify, crop, recolor, or create derivative works
  • Remove or alter watermarks, signatures, or attribution metadata
  • Use the KensiCam name, logo, or wordmark in any way that implies endorsement, partnership, or affiliation

The right-click protection and drag-blocking applied to this site are technical reminders of these restrictions — not a substitute for them. Bypassing them does not constitute permission.

Clients who book a session receive a separate, defined license to their delivered files; see Section 7 (Photo and video usage rights) below for those terms.

Infringement notices (DMCA)

If you believe content on this site infringes a copyright you hold, email info@kensi.cam with:

  • A description of the work you claim is infringed
  • The URL where the alleged infringement appears
  • Your contact information
  • A statement of good-faith belief that the use is not authorized
  • Your physical or electronic signature

We respond to valid notices promptly.

2. Services offered

KensiCam provides VRChat photography and cinematic media services in three lines: Private Portrait Photography, Club & Event Coverage, and Avatar Creator Showcases. Each line has Basic, Plus, and Premium tiers. The deliverables for each tier are listed on the KensiCam website and are part of these Terms by reference.

3. Booking and payment

Booking process

  • You submit an inquiry via the contact form or Discord.
  • We confirm availability, scope, and price via Discord DM.
  • A booking becomes binding once both parties confirm in writing (a Discord message counts as “writing”).

Payment

  • Payment is handled off-site, via Discord DM. We will tell you which payment method to use (e.g. PayPal, Ko-fi). No card details are entered on this website.
  • All prices are in US dollars (USD) unless explicitly agreed otherwise. Currency conversion and processor fees are the Client’s responsibility.
  • Unless agreed otherwise, payment is due before the shoot begins. Larger packages may use a 50% deposit / 50% on delivery split — we’ll confirm this in DM.

4. Delivery

  • First previews — typically within 1 hour after a club event, or within 24 hours for portrait/showcase shoots.
  • Final delivery — within 7 days of the shoot for standard packages; up to 14 days for Premium packages that include cinematic video editing.
  • Files are delivered via a download link sent to your Discord DM unless we agree on another channel.

Delivery timing depends on Client cooperation (e.g. providing avatar access, attending the scheduled session, confirming creative direction on time). Delays caused by the Client extend the delivery window accordingly.

5. Revisions

  • Basic tier: 1 round of light edits (cropping, exposure tweaks) per delivered shot.
  • Plus tier: 2 rounds of revisions.
  • Premium tier: 3 rounds of revisions, including pose/scene re-shoots if creatively warranted.

Major re-direction beyond the agreed brief, or revisions requested more than 14 days after final delivery, are billed at our standard additional rate (quoted on request).

6. Cancellation, rescheduling, and refunds

  • Cancellation by Client more than 48 hours before the shoot: full refund minus any non-recoverable payment-processor fees.
  • Cancellation 24–48 hours before: 50% refund.
  • Cancellation under 24 hours or no-show: no refund.
  • Cancellation by KensiCam (illness, technical failure, force majeure): full refund or reschedule at your choice.
  • Once final files are delivered, the booking is considered complete and is non-refundable.

Rescheduling once is free if requested at least 48 hours in advance. Repeated rescheduling may require a new deposit.

7. Photo and video usage rights (delivered files)

Client rights

  • You receive a non-exclusive, worldwide, perpetual license to use the delivered files for personal use, social media, your avatar listing pages, and your VRChat club’s marketing.
  • You may crop and re-color the images. Removing the KensiCam watermark (where present) is not permitted unless you booked a tier that explicitly excludes it or you purchased a watermark-removal add-on.

KensiCam rights

  • We retain authorship of the photographs and videos.
  • Unless you opt out in writing before the shoot, we may use a selection of the delivered files in our portfolio, on this website, on our Discord, and on the social accounts referenced in the Avatar Showcase package.
  • If you want a fully private shoot with zero portfolio use, tell us before the shoot — we can accommodate this for a small surcharge.

Avatars and copyright

The Client is responsible for ensuring they have the right to be photographed in any avatar they use. KensiCam is not liable for copyright disputes arising from third-party avatar assets the Client chose to wear.

8. Conduct during shoots

  • Shoots take place in VRChat worlds chosen by the Client or agreed in advance.
  • Harassment, hate speech, or content that violates VRChat’s own Terms of Service will end the shoot immediately, with no refund.
  • KensiCam reserves the right to decline or end any session that becomes unsafe or unprofessional.

9. Content standards

This site and our services are intended for an adult audience aged 18 or older. By browsing this website or booking a session you confirm you are 18 or older.

  • All depicted avatars must represent adults. By booking, the Client warrants that they themselves and any other people whose avatars appear in their shoot are 18 or older.
  • We will not photograph or accept commissions for child-presenting avatars (including but not limited to “loli” and “shota” styles), regardless of the operator’s claimed real-world age. We reserve absolute discretion to refuse any avatar we judge to fall in this category.
  • Avatars containing copyrighted material, brand logos, or third-party IP are the Client’s responsibility. KensiCam is not liable for IP disputes arising from avatar choices made by the Client.
  • We reserve the right to refuse any avatar, scene, or world that we judge to be unsafe, illegal in our jurisdiction, or against VRChat’s own Terms of Service.

10. NSFW and adult content

  • Standard packages are SFW. NSFW work is not included by default in any tier listed on this site.
  • NSFW or suggestive work is considered case-by-case, priced separately, and must be agreed in writing before booking.
  • For any NSFW booking, the Client must confirm in writing that (a) they are 18 or older and (b) all avatars depicted in the shoot represent adults aged 18 or older.
  • NSFW work will never be featured in our public portfolio, social media, or marketing materials without a separate explicit written consent from the Client, given for that specific piece of content.

11. Liability

KensiCam’s total liability under or in connection with a booking is limited to the amount the Client paid for that booking. We are not liable for indirect, incidental, or consequential damages, lost profits, or third-party platform issues (VRChat outages, Discord downtime, payment processor failures).

Nothing in these Terms limits liability that cannot be excluded under applicable law (e.g. gross negligence, willful misconduct).

12. Force majeure

Neither party is liable for delay or failure caused by events outside reasonable control: VRChat or Discord outages, ISP failures, illness, power loss, government action, or natural disasters. Affected bookings will be rescheduled or refunded.

13. Governing law and disputes

These Terms are governed by the laws of the State of North Carolina, United States, without regard to its conflict-of-laws principles.

Disputes should first be raised by emailing info@kensi.cam. We will try to resolve them in good faith within 30 days before either party escalates. Any unresolved dispute may be brought before the state or federal courts located in North Carolina.

If you are an EU/UK consumer, this clause does not deprive you of mandatory consumer rights granted by the law of your country of residence.

14. Changes

We may update these Terms from time to time. The version in force at the time of your booking confirmation applies to that booking; updates apply to bookings made after the “Last updated” date shown above.
